LEASE TERMS EXHIBIT
Addendum to Lease Agreement
[Required to be attached to all leases of Units at Hillside at Lenox Condominium]
1. ASSOCIATION IS THIRD-PARTY BENEFICIARY; CONFLICTS. Tenant and Landlord acknowledge and agree that Hillside At Lenox Condominium Association, Inc. is a third-party beneficiary of the promises made in this Addendum. Landlord and Tenant have read, are fully aware of, and will strictly comply with all provisions of this Addendum and with the Declaration, By-Laws, and Association rules and regulations. If there are any conflicts between the Lease Agreement and this Addendum, the provisions of this Addendum shall control.
2. COMPLIANCE AND ENFORCEMENT. Tenant shall control the conduct of family and guests to assure compliance with the Association's legal documents. Landlord shall cause all Occupants to comply with the Declaration, Bylaws, and rules and regulations. Violation of any provision shall constitute a default under the Lease Agreement.
3. PAYMENT OF ASSESSMENTS. Upon request by the Association, Tenant shall pay all unpaid annual and special assessments due during the term of the Lease. If Tenant fails to comply, Tenant shall pay all late charges, interest, costs of collection, and reasonable attorneys' fees.
4. MAINTENANCE. Tenant shall promptly advise the Landlord of any condition requiring repair, and shall advise the Association of any condition of the Common Elements requiring repair.
5. USE OF COMMON ELEMENTS. Landlord assigns to Tenant all privileges to use Association amenities. Delinquency by Landlord in payment of assessments authorizes the Association to suspend Common Elements use privileges.
6. SUBLEASING AND ASSIGNMENT. There shall be no subleasing of the Unit nor shall the Lease be assigned without prior written Board approval.
7. COMMUNICATIONS. Except in emergencies, all questions and communication concerning the Condominium shall be handled between the Owner and the Association.
8. SECURITY. The Association is not a provider of security and shall have no duty to provide security. Landlord and Tenant shall be responsible to protect their person and property.
